These Terms and Conditions govern the relationship between RedOystor DX, a division of RedOystor Media (Pty) Ltd (“RedOystor DX”, “we”, “our”, or “us”) and the client (“you”, “your”, or “the customer”). By ordering or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Service Agreement
1.1. By engaging RedOystor DX’s services, you agree to abide by these Terms and Conditions, our Acceptable Use Policy (AUP), Privacy Policy, POPI Statement, and Terms of Service.
1.2. These documents collectively form a legally binding agreement and govern your use of our services.
2. Client Responsibilities
2.1. You are responsible for maintaining accurate account information and safeguarding login credentials.
2.2. You are solely responsible for the content you host, transmit, or store using our services.
2.3. You must ensure that your usage of our services complies with all applicable laws and does not violate any third-party rights.
3. Provision of Services
3.1. RedOystor DX shall provide services with reasonable skill and care but does not guarantee uninterrupted access or uptime.
3.2. We reserve the right to modify, suspend, or discontinue any service with notice where practical.
3.3. Services may be limited or suspended in cases of abuse, non-payment, or violation of our policies.
4. Fees and Payment
4.1. All fees are payable in advance unless otherwise agreed.
4.2. Payment terms are strictly enforced. Failure to settle accounts may lead to service suspension or termination.
4.3. For services such as domain registration and custom development, payments are non-refundable once the work has commenced.
5. Cancellations and Refunds
5.1. Service cancellations must be submitted in writing and will only be processed upon confirmation.
5.2. Where applicable, refunds will be granted at our discretion, subject to any usage, work completed, and admin fees.
5.3. No refunds are provided for partially used services or promotional offers unless required by law.
6. Domain Names and Email
6.1. Domain registration and renewal are subject to the availability and policies of relevant domain registries.
6.2. You are responsible for renewing your domains on time to avoid expiry or loss.
6.3. Email hosting is provided as-is, and we do not guarantee delivery to third-party servers (e.g., Gmail, Outlook).
7. Limitation of Liability
7.1. RedOystor DX shall not be liable for any indirect, incidental, or consequential damages, including loss of data, income, or profit.
7.2. Our total liability for any claim shall not exceed the amount paid by you for the service in the preceding 30 days.
7.3. You use our services at your own risk. We do not accept liability for third-party service interruptions or failures.
8. Intellectual Property
8.1. All intellectual property developed or provided by RedOystor DX remains the property of RedOystor DX unless otherwise agreed in writing.
8.2. Clients retain ownership of their original content, but grant us a limited license to use, copy, and distribute the content for the purpose of providing the service.
9. Privacy and Data Protection
9.1. Your personal information is handled in accordance with our Privacy Policy and POPI Statement.
9.2. We implement reasonable safeguards to protect your data, but cannot guarantee absolute security.
10. Acceptable Use
10.1. You must not use our services for any unlawful activity, including (but not limited to) spamming, phishing, hosting malicious content, or violating intellectual property rights.
10.2. We reserve the right to investigate and take appropriate action against any misuse of our services, including termination.
11. Termination
11.1. Either party may terminate the agreement by giving 30 days’ written notice, unless otherwise specified in the service terms.
11.2. We reserve the right to terminate services immediately if there is a material breach of these terms or any unlawful activity.
12. Changes to Terms
12.1. RedOystor DX reserves the right to update or revise these Terms and Conditions from time to time.
12.2. Continued use of our services after any changes constitutes acceptance of the updated terms.
13. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.
